EscapeZone LLC ("EscapeZone", "we", "us", or "our") operates escapezone.com and all related information, content, features, tools, products and services (together, the "Services"). Our store is hosted and powered by Shopify, which enables us to provide the Services to you.

This Privacy Policy describes how we collect, use, disclose, and safeguard your personal information when you visit or use the Services, make a purchase or other transaction, or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

1. DEFINITIONS

We do not intentionally collect sensitive personal information such as government identifiers, precise geolocation, health data, biometric data, or information about your racial or ethnic origin, religion, sexual orientation, or trade union membership. Please do not send us this information.


3. SOURCES OF PERSONAL INFORMATION

We may collect personal information from the following sources:

5. HOW WE USE YOUR PERSONAL INFORMATION

Depending on how you interact with us and which Services you use, we may use personal information for the following purposes:

Technical operation. To monitor the usage of the Services and to detect, prevent, and address technical issues.

Where the GDPR or UK GDPR applies, we rely on the following legal bases: performance of a contract with you (to process and fulfill your orders and provide the Services); your consent (for marketing communications and non-essential cookies, which you may withdraw at any time); our legitimate interests (to secure and improve the Services, prevent fraud, and conduct direct marketing to existing customers); and compliance with a legal obligation (for tax, accounting, and regulatory record-keeping).


6. ANALYTICS AND SERVICE PROVIDERS WE USE

Shopify. The Services are hosted by Shopify, Inc., which collects and processes personal information about your access to and use of the Services in order to provide and improve them. See Section 12.

Google Analytics. We use Google Analytics to monitor and analyze use of the Services. Google Analytics is a web analytics service offered by Google that tracks and reports website traffic, and this data may be shared with other Google services. Google may use the data collected to contextualize and personalize the ads of its own advertising network. You can opt out of having your activity made available to Google Analytics by installing the Google Analytics opt-out browser add-on at https://tools.google.com/dlpage/gaoptout, which prevents Google Analytics JavaScript from sharing information about your visit activity. Google reCAPTCHA. We use Google reCAPTCHA to protect the Services from spam and abuse. reCAPTCHA uses risk analysis techniques to distinguish humans from bots. Depending on the version deployed, you may be asked to check a box indicating that you are not a robot, or reCAPTCHA may detect abusive traffic without any interaction from you. reCAPTCHA works by transmitting certain information to Google, such as the referrer URL, IP address, visitor behavior, operating system information, browser type, length of visit, cookies, and mouse movements. Tawk.to live chat. Our website features a live chat service provided by tawk.to Inc. to offer real-time customer support. When you interact with live chat, Tawk.to may collect chat transcripts (the content of messages exchanged), personal information you provide such as your name, email address, or other contact details, technical data including your IP address, browser type, operating system, and timestamps, and usage data such as the pages you visited before starting the chat. This data is used to assist you with inquiries, resolve issues, analyze chat interactions for training and quality assurance, and tailor our responses. Chat data is stored on Tawk.to's servers, which implement industry-standard security measures. Product reviews. We use a third-party product review application (Opinew) to collect, display, and moderate customer reviews. If you submit a review, the reviewer name, rating, review content, any photos you upload, and your order and email information may be processed by that provider to verify and publish your review. Reviews you submit are public.

Shipping, fulfillment, and logistics providers, which receive the name, address, phone number, and email address needed to deliver your order and provide tracking updates.

Other service providers, including IT and hosting providers, data analytics providers, email and SMS delivery platforms, customer support tools, cloud storage providers, and fraud-prevention services.


7. MARKETING, ADVERTISING, AND SOCIAL MEDIA PARTNERS

This section explains in detail how your information is used for advertising, including on Meta (Facebook and Instagram), TikTok, and Google. This is the activity that may be considered a "sale" or "share" of personal information under certain state privacy laws, and you have the right to opt out. See Section 17.

7.1 What we share with advertising partners

When you visit the Services, advertising technologies embedded in our website may collect and transmit information to our advertising partners, including your IP address, cookie and advertising identifiers, device and browser information, the pages and products you view, items you add to your cart, searches you run, purchases you complete, and the value and contents of your order.

In addition, we and Shopify may send certain information to advertising partners directly from our servers (often called server-side tracking, "Conversions API", or "Events API"). This may include a hashed (obscured) version of your email address, phone number, name, city, state, ZIP code, and country, together with your IP address, order value, and event details. Hashing is designed so the partner can match you to an existing account on their platform without receiving your details in readable form. These partners may combine this information with data they already hold about you.

7.2 Meta (Facebook and Instagram)

We use the Meta Pixel and the Meta Conversions API, provided by Meta Platforms, Inc. These technologies allow us to measure the effectiveness of our advertising on Facebook and Instagram, understand which ads lead to visits and purchases, show ads to people who have visited the Services or viewed particular products (retargeting), build Custom Audiences from our customer and visitor lists, and create Lookalike Audiences of people who resemble our existing customers. Meta may act as an independent controller or as our joint controller in respect of this data and will process it in accordance with its own terms and Data Policy.

7.3 TikTok

We use, or may use, the TikTok Pixel and TikTok Events API, provided by TikTok Inc. and its affiliates, to measure the performance of our advertising on TikTok, attribute visits and purchases to TikTok campaigns, retarget people who have interacted with the Services, and build audiences for advertising. Where you interact with our content on TikTok or through TikTok Shop, TikTok may also collect information about that interaction directly.

TikTok processes this data in accordance with its own privacy policy, available at https://www.tiktok.com/legal/privacy-policy. You can manage your advertising preferences in the TikTok app under Settings and privacy, then Ads.

7.4 Google

We use Google Ads, Google remarketing and audience technologies, Google Tag Manager, Google Analytics 4, and Google Merchant Center analytics, provided by Google LLC. These allow us to measure conversions from our search, shopping, video, and display campaigns, show ads to people who have previously visited the Services, upload or match customer lists for Customer Match audiences, and report on shopping and product performance. Google may set advertising cookies through domains including google.com, googleadservices.com, and doubleclick.net.

7.5 Other advertising and social platforms

We may from time to time use additional advertising, retargeting, affiliate, influencer, or social media platforms, including Pinterest, Snapchat, Microsoft Advertising, YouTube, and X, and social sharing or login widgets that allow those platforms to recognize you. Where we do, those platforms process your information under their own privacy policies. If you interact with our pages or content on a social media platform, that platform may collect information about you and your interaction.

7.6 Shopify advertising and audience features

To help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our store, along with other merchants and with Shopify. This includes Shopify's support for personalized advertising with third-party services based on your online activity across different merchants and websites, and Shopify audience products. In these circumstances, Shopify is responsible for the processing of your personal information, including responding to your requests to exercise your rights over the use of your personal information for these purposes. See Section 12.

These tools are cookie-based and device-specific, so you will need to apply them on each browser and device you use. Opting out does not mean you will stop seeing ads, only that the ads you see may be less relevant to you.


8. EMAIL AND SMS MARKETING

Email. If you subscribe to our emails or create an account, we may send you promotional emails about products, offers, and events. You can opt out at any time using the unsubscribe link in any marketing email or by contacting us. If you opt out, we may still send you non-promotional messages, such as messages about your account, your orders, or this policy.

SMS and text messaging. If you provide your mobile number and opt in, we may send you recurring marketing text messages at the number provided, including messages sent by autodialer. Consent to receive marketing texts is not a condition of any purchase. Message and data rates may apply, and message frequency varies. You can opt out at any time by replying STOP to any message, and you can reply HELP for assistance. Carriers are not liable for delayed or undelivered messages.

Mobile information protection. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Mobile opt-in data is used only to deliver the messages you have requested, and is shared only with the messaging platform that transmits them on our behalf.


9. PAYMENT PROCESSING

We use third-party payment processors to securely handle payment transactions on the Services, including Shopify Payments and the accelerated checkout options offered through Shopify such as Shop Pay, together with any additional payment methods displayed at checkout.

When you make a payment, the payment processor collects and processes payment information directly, including credit or debit card numbers, expiration dates, and security codes, along with personal identification information such as your name, billing address, email address, and phone number, and transaction details including the date, time, amount, and currency of the transaction.

Payment processors use this information to process the transaction, detect and prevent fraudulent activity and financial crime, and comply with legal obligations such as anti-money laundering requirements. They may share data with financial institutions, payment networks, and regulators as necessary to process transactions and comply with the law.

Our payment processing is supported by providers certified as PCI Service Provider Level 1, the highest level of certification in the payments industry, and employing security measures including encryption and tokenization. We do not store your full payment card number on our systems.

10. HOW WE DISCLOSE PERSONAL INFORMATION

In certain circumstances we may disclose your personal information to third parties for legitimate purposes subject to this Privacy Policy. These circumstances include:

With Shopify, vendors, and other third parties who perform services on our behalf, such as IT management, hosting, payment processing, data analytics, customer support, live chat, reviews, cloud storage, fulfillment, and shipping.

With business, marketing, and advertising partners, to provide marketing services and advertise to you, as described in Section 7. Our business and marketing partners will use your information in accordance with their own privacy notices. Depending on where you reside, you may have a right to direct us not to share information about you for targeted advertising based on your online activity across different merchants and websites. See Section 17.

When you direct, request, or otherwise consent to our disclosure of certain information to third parties, such as to ship you products, publish a review, or through your use of social media widgets or login integrations.

With our affiliates or otherwise within our corporate group.

In connection with a business transaction, such as a merger, acquisition, asset sale, financing, or bankruptcy. We will provide notice before your personal information is transferred and becomes subject to a different privacy policy.

For legal and safety reasons, including to comply with a legal obligation or valid request by a public authority such as a court or government agency, to respond to subpoenas, search warrants, and similar requests, to enforce our terms or policies, to prevent or investigate possible wrongdoing in connection with the Services, to protect the personal safety of users or the public, to protect and defend the rights or property of EscapeZone, and to protect against legal liability.

Categories of personal information disclosed. In the preceding twelve months, we have disclosed for a business purpose the categories of personal information described in Section 2 to the categories of recipients described above. We have "shared" (for cross-context behavioral advertising) identifiers, device and usage information, commercial and transaction information, and inferences with the advertising partners described in Section 7. We do not sell personal information for monetary consideration, and we do not knowingly sell or share the personal information of consumers under 16 years of age.


11. TRANSFER AND STORAGE OF PERSONAL INFORMATION

Your information, including personal information, may be transferred to and maintained on computers located outside of your state, province, country, or other governmental jurisdiction, where data protection laws may differ from those in your jurisdiction.

If you are located outside the United States and choose to provide information to us, please note that we transfer the data, including personal information, to the United States and process it there. Your consent to this Privacy Policy, followed by your submission of such information, represents your agreement to that transfer.

If we transfer your personal information out of the European Economic Area, the United Kingdom, or Switzerland, we rely on recognized transfer mechanisms such as the European Commission's Standard Contractual Clauses, or any equivalent contracts issued by the relevant competent authority of the UK, unless the transfer is to a country determined to provide an adequate level of protection.

EscapeZone will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy, and no transfer of your personal information will take place to an organization or a country unless there are adequate controls in place, including the security of your data and other personal information.


12. RELATIONSHIP WITH SHOPIFY

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify, as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you.

In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our store, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store, along with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over the use of your personal information for these purposes.

We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on them.

Information you provide on public or semi-public venues, including information you share on third-party social networking platforms, may also be viewable by other users of the Services and users of those platforms, without limitation as to its use by us or by a third party.

Our inclusion of such links does not by itself imply any endorsement of the content on those platforms or of their owners or operators, except as disclosed on the Services.


14. CHILDREN'S PRIVACY

The Services are not directed to, and are not intended to be used by, children. We do not knowingly collect personal information from anyone under the age of 18, or under the age of majority in your jurisdiction.

If you are a parent or guardian and you become aware that your child has provided us with personal information, please contact us using the details in Section 20. If we become aware that we have collected personal information from a child without verification of parental consent, we will take steps to remove that information from our servers.

As of the effective date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" (as those terms are defined in applicable law) the personal information of individuals under 16 years of age.


15. SECURITY OF YOUR INFORMATION

The security of your personal information is important to us. We maintain administrative, technical, and physical safeguards designed to protect your information, including encryption in transit, access controls, and use of PCI-compliant payment processors.

However, please be aware that no method of transmission over the Internet, and no method of electronic storage, is 100% secure, and no security measures are perfect or impenetrable. Any information you send to us may not be secure while in transit. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us.


16. DATA RETENTION

We retain your personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law.

How long we retain information depends on factors such as whether we need it to maintain your account, provide the Services, comply with legal obligations, resolve disputes, or enforce our contracts and policies. For example, we retain order and transaction records for the period required by tax and accounting law, marketing contact information until you opt out and for a reasonable period afterwards to honor your opt-out, and support and chat records for as long as needed to handle your inquiry and for quality assurance.

When we no longer need your personal information, we delete it or de-identify it.


17. YOUR RIGHTS AND CHOICES

Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. These rights are not absolute, may apply only in certain circumstances, and in certain cases we may decline a request as permitted by law.

Right to access or know. You may request access to the personal information we hold about you, including the categories we collect, the sources, the purposes, and the categories of third parties to whom we disclose it.

Right to delete. You may request that we delete personal information we maintain about you.

Right to correct. You may request that we correct inaccurate personal information we maintain about you.

Right of portability. You may request a copy of the personal information we hold about you and ask that we transfer it to a third party, in certain circumstances and with certain exceptions.

Right to opt out of sale or sharing for targeted advertising. Depending on where you reside, you may opt out of the "sale" or "share" of your personal information, or of processing for purposes considered "targeted advertising" under applicable privacy laws. You can exercise this right by using the "Do Not Sell or Share My Personal Information" link in the footer of our website, by adjusting your cookie preferences, by using the platform and industry opt-out tools listed in Section 7, or by contacting us using the details in Section 20.

Right to limit use of sensitive personal information. Where applicable law provides this right, you may request that we limit the use and disclosure of sensitive personal information. As noted in Section 2, we do not intentionally collect sensitive personal information.

Right to withdraw consent. Where we rely on your consent, you may withdraw it at any time. This does not affect the lawfulness of processing carried out before the withdrawal.

Right to non-discrimination. We will not discriminate against you for exercising any of these rights.

Global Privacy Control. If you visit our website with the Global Privacy Control (GPC) opt-out preference signal enabled, then, depending on where you are, we will automatically treat this as a request to opt out of sale and sharing for the device and browser you are using. If we are able to associate the device sending the signal with a Shopify account, we will apply the opt-out request to that account as well.
